1. Introduction
This Privacy Policy and Terms of Service (“Agreement”) governs the relationship between Witty Computer (“We,” “Us,” “Our,” or “Company”) and our clients (“You,” “Your,” or “Client”). By using our services—including web hosting, website building, domain registration, and digital workshops—you acknowledge that you have read, understood, and agree to be bound by all terms and conditions outlined herein.
2. Services Offered
Witty Computer provides the following services:
- Website design and development
- Web hosting and server management
- Domain registration and management
- Digital workshops and training
- Website maintenance and support
- Related digital services as specified in individual quotations
3. Privacy & Data Collection
3.1 Information We Collect
We may collect the following types of information:
- Personal Information: Name, email address, phone number, postal address, and business information provided during registration or contract execution
- Payment Information: Billing details, transaction history, and payment method information (processed securely through third-party payment processors)
- Website Data: Server logs, IP addresses, browser types, pages visited, and access times for website analytics and security purposes
- Communications: Emails, support tickets, and correspondence related to service delivery
3.2 How We Use Your Information
Your information is used for:
- Delivering and managing the services you’ve contracted
- Processing payments and invoicing
- Customer support and communication
- Service improvement and troubleshooting
- Security and fraud prevention
- Compliance with legal obligations
- Marketing communications (only with your consent)
3.3 Third-Party Services
We utilize third-party services including but not limited to:
- Payment processors for secure transaction handling
- Domain registrars (Namecheap, GoDaddy, NameSilo, and others)
- Email service providers
- Website analytics tools
- Cloud hosting infrastructure providers
These third parties have their own privacy policies. We are not responsible for their data practices beyond our contractual agreements with them.
3.4 Data Security
We implement industry-standard security measures to protect your information, including SSL encryption, secure server protocols, and regular security audits. However, no system is completely secure, and we cannot guarantee absolute protection against unauthorized access.
3.5 Data Retention
We retain your personal information for as long as necessary to provide services, fulfill legal obligations, and resolve disputes. Upon contract termination, we will retain your data according to applicable law and our backup/archival procedures.
3.6 Your Privacy Rights
You have the right to:
- Request access to your personal data
- Request correction of inaccurate information
- Request deletion of your data (subject to legal retention requirements)
- Withdraw consent for marketing communications
- Request information about third parties with whom we share your data

4. Payment Terms & Policies
4.1 No Refunds Policy
All payments made to Witty Computer are non-refundable once services have commenced or been delivered. This applies to:
- Initial payments and deposits
- Advance payments (50% or otherwise)
- Completed website designs and development
- Delivered digital workshops and training materials
- Domain registrations
If you are unsatisfied with the service delivery, we will work with you to resolve issues through revisions (as outlined in Section 4.3) or additional support, but refunds will not be issued.
4.2 Full Payment Obligation
You are obligated to pay the entire quotation amount once it has been delivered and accepted by you, regardless of whether you have already paid a 50% advance or any other partial payment.
- Quotations are binding upon your acceptance
- Partial payments do not diminish your obligation to pay the complete amount
- Failure to pay the full quotation will result in service suspension and may result in legal action to recover outstanding fees
- Late payments may accrue interest or late fees as specified in individual contracts
4.3 Website Revisions
All websites delivered by Witty Computer include two (2) rounds of revisions at no additional cost. These revisions include:
- Design and layout adjustments
- Content modifications
- Minor functionality tweaks
- Bug fixes
Additional revisions beyond the initial two rounds require a separate quotation and are not included in the original service agreement. You will be notified of any additional revision requests and provided with pricing before work begins.
4.4 Invoicing & Payment Methods
- Invoices are issued upon project initiation or as specified in your contract
- Accepted payment methods will be outlined in your quotation
- Payment is due according to the terms specified in your contract (typically 50% upon signing, 50% upon delivery)
- All payments must be in the currency specified in your invoice
5. Domain Registration & Management
5.1 Third-Party Registrar Services
Witty Computer offers domain registration as a service to our clients, not as a profit center. We partner with various domain registrars including (but not limited to):
- Namecheap
- GoDaddy
- NameSilo
- Other ICANN-accredited registrars
5.2 Registrar Independence & Limitations
Witty Computer is not responsible for actions taken by third-party domain registrars. We cannot be held liable if a registrar:
- Blocks, suspends, or deletes a domain
- Changes their terms of service or policies
- Implements new security measures that affect access
- Terminates their services
- Modifies pricing, renewal terms, or registration requirements
- Takes any other action within their authority as domain registry operator
5.3 Best Practices Commitment
While we implement industry best practices for domain management, including:
- Maintaining accurate WHOIS information
- Ensuring timely renewal before expiration
- Monitoring domain security
- Backing up DNS records
…these practices do not guarantee protection against registrar actions or technical failures beyond our control.
5.4 Your Responsibilities
You are responsible for:
- Providing accurate contact and registrant information
- Notifying us of any unauthorized access or suspicious activity
- Maintaining payment methods on file for auto-renewal
- Reviewing domain registration agreements with third-party registrars
- Complying with registrar terms of service
5.5 Domain Transfer & Ownership
Domains are registered in your name or your specified entity. You have the right to transfer your domain to another registrar or management provider at any time, provided that:
- All invoices with Witty Computer are paid in full
- You provide proper authorization and documentation
- The domain is not locked or subject to dispute
6. Legal Compliance & Acceptable Use
6.1 Client Responsibility for Legal Compliance
You are solely responsible for ensuring that all products, services, and content on your website comply with all applicable local, state, national, and international laws and regulations. This includes but is not limited to:
- Consumer protection laws
- Data protection and privacy regulations (GDPR, CCPA, etc.)
- Intellectual property laws
- E-commerce regulations
- Industry-specific regulations and licensing requirements
- Tax and financial regulations
6.2 Prohibited Activities
You agree not to use Witty Computer’s services for:
- Illegal activities or services
- Harassment, defamation, or abuse
- Distribution of malware, spyware, or harmful code
- Phishing, fraud, or deceptive practices
- Violation of intellectual property rights
- Spam or unsolicited communications
- Content that violates applicable laws
- Any activity that would harm Witty Computer’s reputation or operations
6.3 Content Responsibility
Witty Computer does not review or approve the content you publish on your website. You acknowledge that you are solely responsible for all content, including text, images, videos, and any other materials. We are not liable for content that may violate laws or harm third parties.
6.4 Termination for Illegal Activity
Witty Computer reserves the right, at its sole discretion, to immediately terminate services if we determine that:
- Your website or activities violate applicable laws
- Your business involves illegal products or services
- Your activities are immoral or unethical (as determined by Witty Computer in good faith)
- You violate the terms of this Agreement
In the event of termination due to illegal or immoral activity, no refunds will be issued, and we will not be liable for any damages resulting from service termination. We may also report illegal activity to appropriate authorities if required by law.
6.5 Reserved Right to Terminate
Witty Computer expressly reserves the right to determine what constitutes “illegal or immoral activity” based on:
- Applicable laws in our jurisdiction and yours
- Industry standards and best practices
- Our company values and policies
- Community standards and regulations
- The nature and severity of the violation
7. Intellectual Property
7.1 Ownership of Work Product
Upon full payment of all invoices:
- Custom website design and code created by Witty Computer becomes your property
- Pre-designed templates, frameworks, or components may remain subject to licensing terms
- Third-party plugins, themes, or assets retain their original licensing
7.2 Your Content
You retain all intellectual property rights to content you provide (text, images, etc.). By providing this content, you grant Witty Computer a license to use it for the purpose of delivering services.
7.3 Portfolio Use
Witty Computer may use screenshots or descriptions of completed projects in our portfolio and marketing materials, unless you specifically request otherwise in writing.
8. Website Hosting & Uptime
8.1 Service Availability
While we strive to maintain 99% uptime, Witty Computer does not guarantee uninterrupted service. Downtime may result from:
- Scheduled maintenance and updates
- Infrastructure failures
- Third-party hosting provider issues
- Security attacks or technical incidents
- Force majeure events
8.2 Backups
We maintain regular backups of your website data. However, backups are provided on a best-efforts basis and should not be relied upon as your sole backup solution. You are encouraged to maintain your own backups.
8.3 Data Loss
Witty Computer is not liable for data loss or corruption, except where such loss results directly from our negligence. You are responsible for maintaining adequate backups of critical data.
9. Limitation of Liability
9.1 Disclaimer of Warranties
Witty Computer’s services are provided “as is” and “as available.” We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 Limitation of Damages
In no event shall Witty Computer be liable for:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Damages exceeding the amount paid for services in the prior 12 months
- Any damages arising from third-party actions, including registrar actions or payment processor failures
9.3 Third-Party Services
Witty Computer is not liable for services provided by third parties (payment processors, domain registrars, email providers, etc.). Your remedies for third-party failures should be directed to those providers.

10.2 Response Time
We aim to respond to support inquiries within 48 business hours. Response times may vary based on the complexity of your request.
11. Modifications to Terms
Witty Computer reserves the right to modify this Agreement at any time. Changes will be effective upon posting to our website. Your continued use of our services constitutes acceptance of modified terms. For existing contracts, modifications will not apply retroactively unless required by law.
12. Indemnification
You agree to indemnify and hold harmless Witty Computer, its owners, employees, and agents from any claims, damages, or expenses arising from:
- Your use of our services in violation of this Agreement
- Content you provide or publish
- Your violation of applicable laws
- Violation of third-party rights
- Claims by third parties related to your website or business activities
13. Dispute Resolution
13.1 Governing Law
This Agreement is governed by and construed in accordance with the laws of the jurisdiction in which Witty Computer operates, without regard to conflict of law principles.
13.2 Disputes
Any disputes arising from this Agreement or your use of our services shall be resolved through:
- Good-faith negotiation and discussion
- Mediation (if both parties agree)
- Binding arbitration or litigation as permitted by applicable law
14. Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full effect.
15. Entire Agreement
This Agreement, along with any quotation, invoice, or contract you have signed, constitutes the entire agreement between you and Witty Computer regarding our services. It supersedes any prior understandings or agreements.
